1. ACCOUNTS

a) Registration and KYC Information (Merchant)

To comply with anti-terrorism, financial regulations, and KYC (Know Your Customer) requirements, the merchant/agent must provide TheTechx with accurate information about their identity, activities, and shareholders.

The merchant is required to give TheTechx at least three (3) business days’ written notice of any changes related to KYC information. Upon request, the merchant shall provide any additional documentation TheTechx reasonably deems necessary to remain compliant with applicable laws and Acquirer KYC requirements.

The merchant agrees that TheTechx may conduct further checks on their identity, creditworthiness, and background by consulting relevant registries and government authorities.

TheTechx’s acceptance of a merchant to use its services is personal and solely for transactions involving the merchant’s own products and services. Merchants are strictly prohibited from using TheTechx’s services to process payments for third-party products or services and may not resell TheTechx’s services.


2. RECEIVING FUNDS

a) Risk of Reversals, Chargebacks, and Claims

When a merchant receives a payment, they are fully liable to TheTechx for the entire transaction amount plus any applicable fees if the payment is later invalidated for any reason. This includes responsibility for chargebacks, reversals, or claims.

The merchant authorizes TheTechx to recover such funds by debiting their account balance. If the balance is insufficient, the merchant agrees to reimburse TheTechx through alternative means. In the case of a chargeback, the final decision lies with the card issuer—not TheTechx.

b) Refund Policy and Privacy Policy

TheTechx requires all merchants to maintain a published Refund Policy and Privacy Policy on their website. If the merchant is unable to provide the agreed-upon goods or services due to circumstances beyond their control, a refund must be issued.

Refunds will be processed only if TheTechx has sufficient evidence that a transaction involved fraud or misrepresentation and that the customer acted in good faith. A refund will be issued once the appropriate investigation is complete.


3. SETTLEMENTS

a) TheTechx will settle funds to the merchant’s account based on agreed-upon terms. Any fees owed to TheTechx will be deducted from the merchant’s settlement.

b) Currency exchange rates for settlement transactions will be based on the official rates provided by banks responsible for currency remittance.


4. MERCHANT’S LIABILITY

4.1 General

Merchants are liable for all refunds, chargebacks, claims, fees, fines, penalties, and other losses incurred by TheTechx, users, or third parties due to the merchant’s breach of these terms.

The merchant agrees to reimburse TheTechx or any affected party for these liabilities. TheTechx will notify the merchant of such liabilities and may withhold funds from the merchant’s balance to cover them.

4.2 Payments on Demand

TheTechx’s payment system must be used solely for the sale of legitimate products and services. The merchant bears full responsibility for all goods and services sold using TheTechx. All activities must comply with applicable laws and TheTechx’s compliance policies.

Use of TheTechx’s services for illegal purposes is strictly prohibited and may result in legal action, including criminal prosecution.


5. RESTRICTED ACTIVITIES

a) If TheTechx suspects that a merchant is engaged in restricted or unauthorized activities, it may take action to protect itself, users, and third parties. This includes freezing the merchant’s account or reporting the account to local authorities—especially if TheTechx’s payment gateway is being used without written consent.

b) Account Closure, Termination, and Limited Access

If TheTechx closes a merchant’s account or terminates their access to services, a notification will be provided. The merchant acknowledges that some decisions, including restrictions on account access or reserves placed on funds, are based on confidential internal risk assessments. TheTechx is under no obligation to disclose these internal policies or procedures.


6. APPLICABLE LAW

All business activities and legal relations with TheTechx are governed by the laws of the United Arab Emirates.


7. THE THECHX LOGO USAGE POLICY

7.1 Introduction

The TheTechx logo is a key representation of our corporate identity, values, and services. This policy outlines the correct usage of the logo to ensure consistency and to protect our brand integrity.

7.2 Scope

This policy applies to all TheTechx staff, independent agents, and authorized third parties who use the logo across digital, print, or promotional platforms.

7.3 Logo Usage Guidelines

Authorized Use:

The TheTechx logo may only be used by:

a) TheTechx employees and subcontractors
b) Marketing and sponsorship partners
c) Authorized resellers and distributors

Unauthorized Use:

Any unauthorized use of the TheTechx logo is strictly prohibited and may result in legal consequences. TheTechx’s logo is a registered trademark protected under intellectual property laws.

Reproducing, modifying, or distributing the logo in any form without prior written consent from TheTechx is not permitted. This includes use on websites, social media, marketing materials, or merchandise.
